About these terms

These terms apply when you use sarahthurn.com and set out the general basis on which I, Sarah Thurn, provide my services. By using this website, you agree to them.

Each engagement is also covered by a written proposal or agreement. If anything in your proposal differs from these terms, the proposal applies.

Using this website

The content on this site is general information about my services. It isn't legal, financial or other professional advice, and you shouldn't rely on it as such.

I keep the site accurate and up to date, but I can't guarantee it will always be available or free of errors. Links to other websites are provided for convenience; I'm not responsible for their content.

Please don't misuse the site, including by trying to gain unauthorised access, interfering with how it works, or copying it in bulk.

Intellectual property

The text, logo, photographs and design of this website belong to me or are used with permission. You're welcome to share links to the site, but please don't copy or reuse its content without my written consent.

Enquiries and proposals

An enquiry or introductory call doesn't commit either of us to anything. After we speak, I'll send a written proposal setting out the scope, fees, term and how we'll work together. An engagement begins once you accept the proposal in writing.

Providing the services

I'll deliver the agreed services with due care and skill, and within the scope and approval rules we set during onboarding. I act on your instructions. Decisions about your business remain yours.

To do the work well, I'll need timely access to the people, systems and information the scope requires. If the scope changes, we'll agree any change in writing first.

Fees and payment

Fees are fixed monthly and set out in your proposal, along with payment terms. Unless we agree otherwise, out-of-pocket costs incurred for you, such as travel or bookings, are approved by you first and passed on at cost.

Confidentiality

Everything I learn about you and your business during an engagement is confidential. I won't disclose it to anyone without your permission, except where the law requires it. I'm happy to sign your non-disclosure agreement before we discuss anything in detail.

Term and ending an engagement

The minimum term and notice period for your engagement are set out in your proposal. Either of us may end an engagement straight away by written notice if the other seriously breaches these terms or the proposal and doesn't fix the breach within 14 days of being asked.

When an engagement ends, I'll hand over work in progress, return or securely delete your information, and give back any access I was given.

Australian Consumer Law

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can't lawfully be excluded.

Limitation of liability

To the extent the law allows, my total liability to you for any claim arising from the services is limited to the fees you paid me for those services in the three months before the claim arose. I'm not liable for indirect or consequential loss, such as loss of profit or opportunity.

Privacy

My privacy policy explains how I handle personal information.

Governing law

These terms are governed by the laws of Australia and of the state or territory where I am based. You and I agree to the non-exclusive jurisdiction of the courts there.

Changes to these terms

I may update these terms from time to time. The date at the top of the page shows when they last changed. Changes won't affect an engagement already underway unless we both agree. Questions are welcome at [email protected].
